Terms of Service
Effective 8 October 2026
1. About these terms
These Terms of Service ("Terms") are an agreement between you and MyATS Online Suite ("MyATS", "we", "us"). They cover our recruitment software (MyATS360, MyNetwork360, MyPeople360 and MyPanelist360), our websites and our iPhone and Android apps (together, the "Services"). By creating an account, signing in, or otherwise using the Services you accept these Terms and our Privacy Policy. If you use the Services for an organisation, you confirm that you are allowed to accept these Terms for it, and "you" includes that organisation.
If you do not agree, do not use the Services.
2. Who can use the Services
The Services are for business use by people aged 18 or over. You must give accurate information and keep it up to date. We may ask you to verify your identity or your organisation.
3. Accounts and roles
- An organisation's workspace is managed by its administrators, who can invite people and choose their role (admin, manager, team lead, recruiter, viewer or panelist) and which pages each role can open.
- You are responsible for everything done through your account. Keep your password private, use a strong one, and tell us promptly at hello@myatsonline.com if you think someone else has used your account.
- Administrators are responsible for removing access for people who leave the organisation.
4. Your data
- You own your data. You keep all rights in the content you or your users put into the Services ("Your Data"), such as candidate records, resumes, requirements, client details, comments and interview recordings.
- Our permission to use it. You give us a limited licence to host, process, copy and display Your Data only to run, secure, support and improve the Services for you, and as described in our Privacy Policy.
- Your responsibilities. You promise that you have the right to put Your Data into the Services and that you have given candidates and others any notices and obtained any consents the law requires. This includes telling candidates about video interviews and AI-assisted review. Collect sensitive items such as government identity numbers (PAN, Aadhaar, passport) only if you have a lawful need for them, and handle them with care.
- Our role. For personal data in Your Data, you decide the purpose and means of processing and we process it on your instructions as described in the Privacy Policy. You can export or delete Your Data using the Services, or ask us to.
5. Acceptable use
You must not:
- break the law or someone else's rights, or use the Services to discriminate unlawfully against anyone;
- upload malware, or try to disrupt, overload or bypass the security of the Services;
- access data or accounts that are not yours, or share your access with people outside your organisation;
- copy, resell, reverse engineer or build a competing product from the Services, except as the law allows;
- use bots or scrapers on the Services without our written permission;
- use the Services to send spam or misleading messages;
- put in the Services content that you have no right to use or that is unlawful or harmful.
We may remove content or suspend access if we reasonably believe these rules are broken.
6. AI-assisted features
Some features use artificial intelligence to read resumes, explain requirements, suggest questions, summarise screenings and draft advisory scores for recorded interviews.
- AI output can be incomplete or wrong. It is meant to help a human reviewer and is not professional, legal or hiring advice.
- You are responsible for decisions you make about candidates. Do not rely on AI output alone to reject or select anyone, and follow the laws that apply to you.
- Content may be sent to our AI providers to produce results, as described in the Privacy Policy.
7. Free trial, plans and payment
- New workspaces may start with a free trial. At the effective date the trial lasts 60 days with full access. We may change future trials.
- After the trial, continued use needs a paid plan agreed with us on our website or in writing. Prices are as shown to you when you buy and are exclusive of GST and other taxes unless we state otherwise.
- The mobile apps do not sell anything and have no in-app purchases. They give signed-in users access to a workspace that was set up on our websites or with us directly.
- Fees already paid are non-refundable except where the law requires or we agree otherwise in writing.
- If a plan is not renewed, we may limit or end access after giving you notice. Section 12 explains what happens to Your Data.
8. Our property
The Services, including the software, design, logos, product names and documentation, belong to us and our licensors and are protected by law. We give you a limited, non-exclusive, non-transferable right to use the Services during your term under these Terms. You must not remove notices or use our names or logos without our written permission. If you send us ideas or feedback, we may use them freely without paying you.
9. Third-party services
The Services work with services from other companies, for example for hosting, sign-in, email and AI. These are listed in the Privacy Policy. We are not responsible for services that are not ours, and their own terms may apply when you use them directly.
10. Availability and changes
We work to keep the Services available and to protect Your Data, but we do not promise they will be uninterrupted or error-free. We may maintain, update, change or retire features. We will give reasonable notice of changes that significantly reduce functionality you rely on.
11. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties not stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Ending your use
- You may stop using the Services at any time. Customers can ask us to close their workspace by writing to hello@myatsonline.com.
- We may suspend or end access if you break these Terms, if payment is overdue, if required by law, or if continuing would put the Services or other users at risk. Where reasonable we will tell you first.
- After a workspace closes, you have 30 days to ask for an export of Your Data. After that, we delete or irreversibly anonymise it within 90 days of closure, as set out in the Privacy Policy, unless the law requires us to keep it.
- Sections that by their nature should continue (including 4, 8, 11, 13, 14 and 15) survive termination.
13. Limit of liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill or data, even if we were told it could happen; and
- our total liability to you for all claims about the Services is limited to the fees you paid us in the 12 months before the claim arose, or ₹10,000 if you paid nothing.
Nothing in these Terms limits liability that the law does not allow us to limit.
14. Indemnity
You will defend and cover us against claims, losses and costs (including reasonable legal fees) from third parties arising out of Your Data, your breach of these Terms or the law, or your use of the Services in a way that is not allowed. We will tell you promptly about any claim and reasonably co-operate with you.
15. Governing law and disputes
These Terms are governed by the laws of India. We will first try to settle any dispute in good faith through discussion for 30 days after one side notifies the other in writing. If that fails, the courts of competent jurisdiction in India have exclusive jurisdiction.
16. General
- Changes. We may update these Terms. We will post the new version with a new effective date and, for material changes, give notice by email or in the Services at least 30 days before they apply. If you keep using the Services after that date, you accept the update. If you do not accept it, stop using the Services.
- Whole agreement. These Terms and the Privacy Policy are the whole agreement between us about the Services, unless you have a separate written agreement with us, which then takes priority for the matters it covers.
- If a part is unenforceable, the rest stays in force. If we do not enforce a right straight away, we have not given it up.
- Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours as part of a merger, acquisition or sale of the business.
- Electronic notices. We may give notices by email, in the Services or on our websites.
